INFLATABLE RENTAL LIABILITY WAIVER & RELEASE – READ CAREFULLY

1. FULL ASSUMPTION OF RISK

Lessee acknowledges that inflatable amusement devices involve known and unknown risks including but not limited to:

​

• Falls

• Collisions

• Entrapment

• Equipment malfunction

• Negligence of participants

• Severe injury

• Paralysis

• Death
   

Lessee voluntarily assumes ALL risks, whether foreseeable or unforeseeable.

 

2. SUPERVISION REQUIREMENT

A competent adult 18 years or older must supervise the inflatable at ALL times.

Failure to supervise constitutes negligence by the Lessee.

Blow It Up LLC does NOT provide attendants unless explicitly contracted in writing.

 

3. SITE READINESS (CRITICAL PROTECTION)

Lessee agrees the setup area will be:

• Level

• Dry

• Free of debris

• Free of animal waste

• Accessible

• Within 100 feet of adequate electrical power
   

If the site is not safe or suitable upon arrival:

✅ The Company may refuse setup
✅ Payment remains non-refundable

 

4. WEATHER & WIND POLICY (BIG LIABILITY REDUCER)

Inflatables may NOT be operated in:

• Rain

• Thunderstorms

• Lightning

• Winds exceeding 15 MPH

• Gusty or unpredictable conditions
   

Lessee agrees to immediately shut off and evacuate the unit if conditions become unsafe.

Weather Cancellations:

• Cancel 48+ hours prior: Rain check valid for 12 months

• Cancel under 48 hours: Deposit forfeited

• Same-day cancellations: Non-refundable
   

Once equipment is delivered, no refunds will be issued due to weather.

 

5. NON-REFUNDABLE DEPOSIT

​

All reservations require a deposit.

​

Deposits are NON-REFUNDABLE except when the Company cancels.

Rain checks may be issued at the Company’s discretion.

 

6. CREDIT CARD DAMAGE AUTHORIZATION (EXTREMELY IMPORTANT)

 

By booking, Lessee authorizes Blow It Up LLC to charge the card on file for:

​

• Cleaning fees (minimum $100)

• Repair costs

• Replacement costs (up to $4,000 per unit)

• Theft

• Collection fees

• Attorney fees
   

If charges are declined, Lessee agrees to pay immediately upon invoice.

 

7. PROHIBITED ITEMS & ACTIONS

​

The following are strictly prohibited:

​

🚫 Shoes
🚫 Food or drinks
🚫 Gum
🚫 Face paint
🚫 Glitter
🚫 Silly string
🚫 Pets
🚫 Smoking/vaping
🚫 Fireworks
🚫 Grills/open flames
🚫 Sharp objects

​

Violation may result in immediate termination of the rental without refund.

 

8. SAFE OPERATION RULES

​

Lessee agrees to enforce:

​

• No flipping or wrestling

• No climbing walls/netting

• Separate children by size

• Follow occupancy limits

• Slides used feet-first only

• No water unless approved for water units
   

Only children 11 and under unless authorized.

 

9. EQUIPMENT CONTROL

​

Lessee may NOT:

​

• Move the inflatable

• Sublease

• Relocate

• Alter equipment

• Attach unauthorized items
   

Blow It Up LLC may enter the property to inspect or retrieve equipment at any time.

 

10. DAMAGE, LOSS, OR THEFT

​

Lessee is responsible for the equipment from delivery until pickup.

Charges include:

​

• Excessive dirt/mud

• Staining

• Burns

• Tears

• Vandalism

• Theft
   

Total loss may be charged up to $4,000 per inflatable.

 

11. WATER SLIDE REQUIREMENTS

​

Failure to turn off water before deflation results in a minimum $100 fee.

Do NOT hose down dry units.

 

12. OVERNIGHT RENTALS

​

If approved:

​

• Blowers must be removed and secured indoors.

• No sleeping inside inflatables.
   

Lessee assumes full theft and weather risk.

 

13. FORCE MAJEURE

​

Blow It Up LLC is not liable for failure to perform due to events beyond control including:

​

• Severe weather

• Acts of God

• Power outages

• Government orders

• Emergencies
   

 

14. INDEMNIFICATION (LAWSUIT SHIELD)

​

Lessee agrees to defend, indemnify, and hold harmless Blow It Up LLC from ALL claims arising from:

​

• Equipment use

• Injuries

• Property damage

• Negligence of participants

• Failure to supervise
   

Including claims alleging negligence by Blow It Up LLC to the fullest extent permitted by law.

 

15. RELEASE OF LIABILITY

​

Lessee permanently releases Blow It Up LLC from any claims for injury, death, or damages resulting from use of the equipment.

​

The Company provides no warranties, expressed or implied.

 

16. ARBITRATION AGREEMENT 

​

Any dispute shall be resolved through binding arbitration in the State of Maine.

Lessee waives the right to:

​

✅ Jury trial
✅ Class action
✅ Court litigation

 

17. PHOTO & VIDEO RELEASE

Lessee grants permission for photos of rental setups to be used for marketing unless declined in writing. (No participant names will be used.)

 

18. ELECTRONIC SIGNATURE

Electronic signatures and checkbox agreements are legally binding and enforceable.

 

19. SEVERABILITY

If any clause is found unenforceable, the remainder of the agreement remains valid.
